Please read the following terms of service (the "terms and conditions” or the " agreement") carefully; it is a binding legal agreement. By checking the "I Accept terms & Conditions" and I heard & understood in my Own language, you agree to be legally bound by the terms and conditions of this agreement while becoming a smartway distributor. Access to the Services

SMARTWAY INDIA is offering the Service solely for use by the person or entity in whose name an account is registered through the Site (the "registration" or "you") and not for the use or benefit of any third party.

There is no fee or no commission for enrollment

If anyone would like to buy a product from smartway they have to pay cash in to the company bank account directly. Register the details into the company website and shall receive an SMS with Pin Number with in a day or two. If the person did not receive the SMS within 5 working days, the person have the responsibility to notify the company through customer care number or company email.

SMARTWAY INDIA reserves the right, at its discretion, to modify this Agreement at any time by posting a notice on the Site, or by sending Subscriber a notice via e-mail, and you consent to receipt of such notice.

Legal Terms

When signing up for the Service, you must provide your full legal name, full bank address,Pan Card copy a valid e-mail address, working mobile number and any other information requested in order to complete the signup process.

You must be 18 years or elder to use this Service.

You are responsible for maintaining the security of your account and password.

SMARTWAY INDIA cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. SMARTWAY INDIA reserves the right to refuse Service to anyone, or cancel an account, for any reason at any time without notice.

Any associate who wish to buy a product from smartway shall have a valid bank account and they themselves pay the money to the company account through bank /post office / any other financial institutions. Once deposited the money, they have to notify the details of the deposits to the company.

Leaders/Any associates are not allowed to take cash / money from any other persons for associating them into the company.

Service and Products General Conditions

Technical support is only available via email / customer care number. While SMARTWAY INDIA will work to respond to all requests within 24 hours.

You must understand that SMARTWAY INDIA is not a manufacturer, we supply / sell the manufacturers product directly to the customer through courier.

Warranty Disclaimer

The warranty status of the each product shall be mentioned in the site for easy reference.

Modification to Service

SMARTWAY INDIA reserves the right at any time or periodically to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

Such notice may be provided at any time by posting the changes to the SMARTWAY INDIA Web Site (smartwayindia.in) or the Service itself.

SMARTWAY INDIA shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

Any new government rules and regulations in the future shall be adopted and changes done accordingly.

Payments, Upgrading and Downgrading

SMARTWAY INDIA reserves the right to permanently delete, without notice, any account in the Service without any active service that maintains a period of inactivity for 30 days.

The Service is billed in advance on a one time basis and is non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.

To keep active your account, it is mandatory to buy product from smartway on a monthly basis. And need to keep funds in your PIN Account.

Cancellation and Termination

You are solely responsible for properly canceling your account. An email to [email protected] for your verified registered email id will be used to cancel your account.

Account information cannot be recovered once your account is cancelled. If you cancel your Service you will receive a product worth of unused portion of the amount.

Cancel your product and refund the money only once we receive the return courier of the product and there the courier charges and the taxes will be deducted.

Electronic Delivery Policy

You agree that we may provide you required notices, agreements and other information concerning the Service electronically.

While refunds will be handled promptly when warranted, by using the Services, you also agree that.

SMARTWAY INDIA it is not responsible for valid charges incurred as the result of failed electronic delivery of email messages to the address you provide, either by the fault SMARTWAY INDIA or another third party.

Resolution of Disputes

Any disputes arising out of the use of the Service shall be governed by the laws of India, without regard to any conflict of law principles, and any proceedings shall solely be brought in the Court located in Delhi India. You consent to the exclusive jurisdiction of and venue in such courts. You also acknowledge and agree that the venue provided for herein is the most convenient forum for both, you and SMARTWAY INDIA and waive any objection to jurisdiction and/or venue and any objection based on a more convenient forum in any action between, you and SMARTWAY INDIA (and /or its officers, directors, employees, members and agents) and/or otherwise in connection with the Service
